Professor David Harris says that the re-trial of State Senator Jane Orie confronts the defendant with greater risks and higher stakes than she faced in her first trial. After that case ended in a mistrial upon discovery of allegedly forged defense exhibits, prosecutors added multiple counts concerning the false documents. According to Professor Harris, allegations like these describe "a fraud on the system. You can't underestimate how seriously a judge would take that."
