David Harris on Verdict for Pittsburgh in Police Officer Road Rage Case
Professor David Harris commented on the verdict in favor of the City of Pittsburgh in a case brought by a man assaulted by a police officer in a road rage incident. The victim sued the city and the police department for failure to supervise and discipline the officer. The judge in the case left the decision on whether the officer was acting "under color of law" to the jury. According to Professor Harris, some judges "might have made a legal decision" on the issue themselves. Now it will be subject to an appeal after a full trial.
