John Burkoff on Denial of Sen. Orie's Double Jeopardy Motion
Professor John Burkoff commented on the denial of the motion of State Senator Jane Orie, in which she argued that retrying her would violate the double jeopardy clause. Near the end of Orie's trial, the judge declared a mistrial when defense documents appeared to have been forged, a conclusion since upheld by a Secret Service forensic analysis. According to Professor Burkoff, "The judge has said [the defense] can't take advantage of (the mistrial), end of story."
