David Garrow on the Health Care Decision and the U.S. Supreme Court
David Garrow, Research Professor of History and Law at Pitt, discussed the impact of the health care decision on the U.S. Supreme Court itself. His comments came in the National Law Journal. With Chief Justice Roberts siding with four justices to declare the individual mandate constitutionally valid under the taxing power, the focus has been on why the conservative Roberts took this step. According to Professor Garrow, "I think it's hard to avoid concluding that there was a political attraction for John Roberts to avoid the appearance, if not the reality, of a big interbranch confrontation."
