Rhonda Wasserman on Civil Procedure Reform

Together with Professors Arthur Miller, Erwin Chemerinsky, Michael Solimine, Adam Steinman and Farish Percy, on March 23  Professor Rhonda Wasserman submitted an amici curiae brief to the United States Supreme Court in Powerex Corp. v. Reliant Energy Services, Inc. (05-85).  Amici argue that the Court should interpret 28 U.S.C. § 1447(d) to bar appellate review of remand orders regardless of the reason offered by the district court for the remand and encourage the Court to overrule its decision in Thermtron Products, Inc. v. Hermandsdorfer, 423 U.S. 336 (1976) or to limit it to its particular facts.  The brief was written by Professor Miller and Gregory Beck and Brian Wolfman of Public Citizen Litigation Group.
