This seminar will examine the legal issues that arise because of the decline and loss of mental capacity among the elderly. Several million older Americans suffer varying degrees of loss of mental capacity that reduces their ability to live safe, independent, autonomous lives. We will examine the extent and the causes of the loss of mental capacity, the difficulties that it causes for individuals and their families, and the legal response. We will critique powers of attorney, surrogate decision making and guardianship, as well as other legal responses to mental incapacity.
