John Burkoff on Changes of Venue and/or Venire

Professor John Burkoff was quoted in the Pittsburgh Tribune-Review in connection with choosing a jury in the trial of accused murderer Richard Poplawski.

“He still has a difficult decision to make. People know about what happened. For the people that don’t, the question is, does (the judge) want that group of people to determine the case?” said University of Pittsburgh law professor John Burkoff. “The judge has a lot of discretion. It’s a balancing process.”

Burkoff said the recent fatal shooting of Penn Hills police Officer Michael Crawshaw does not bode well for Poplawski’s potential jury pool.

“I think it has a slight impact. It reminds everyone in the region of the earlier shooting of the police officers and it makes us all upset.”
